| MEMBERSHIP AGREEMENT - Terms and Conditions of Use
By joining PrivateLessons.com ("Service"), you ("you", "user", "member") agree to the following terms
and conditions. PrivateLessons.com and MusicRoster.com ("PrivateLessons.com", "MusicRoster.com", "PrivateLessons", "MusicRoster" or "we")
may revise these terms at any time, at our sole discretion, by updating this page. By using this Service you agree with all the terms and
conditions and all revisions thereof.
1. TERMS
- PrivateLessons.com: Membership-based, proprietary network for independent music professionals, provided on "as is" and "as available" basis
- Annual Membership: $99 USD for one (1) teacher
- No Other Fees: There are no fees for student leads or commissions on gigs or job referrals
- Agreement Terms Box: All members must check off agreement box before the system will allow to pay
- No Refunds: Membership fees are NOT refundable
2. RULES
- HONOR SYSTEM NETWORK: PrivateLessons.com provides flexible level of user-controlled customization and operates on an honor basis. We requests that members exercise self-government and fare practices to help maintain the finest service in our niche.
- MEMBER DEFINITION: PrivateLessons.com Member is defined as one individual, independent music teacher
- ACCOUNT DEFINITION: One PrivateLessons.com Account is designated for one (1) music teacher
- NO MUSIC SCHOOLS, NO LARGE STUDIOS, that employ or contract music teachers, may list on PrivateLessons.com
- COMPLIANCE: Members are required to display information designated by specific database field instructions
- FIRST & LAST NAME: Members are required to display their legitimate names. Unrelated data interferes with administrative functions and will be removed without notice.
- PRIVACY: Members may NOT publish the following items on publicly displayed Resume pages:
(a) personal E-Mail addresses
(b) re-directing URLs, in any form
(c) and Phone numbers
- GEOGRAPHIC LISTING: Members must list only in local metro areas of their residence. Excessive listing in other areas is grounds for disqualification.
- MAPPING SERVICE: We use MapQuest as our external mapping service to show your general geographic location based on street address data you provide in your resume forms. We do not publish your personal address on PrivateLessons.com pages, however that information displays on pages of mapping service site. We recommend that you show INTERSECTION vs. ACTUAL ADDRESS.

- INSTRUMENTS LISTING: Members may list up to three (3) instruments.
- RESUME DATABASE SPAMMING: We will disqualify members who, to boost search results, add excessive number of irrelevant musical instruments beyond the ones they teach, as well as geographic areas
- IMAGES: We reserve the right to use members' photographic images and forum content to promote PrivateLessons.com Service
- HEAD SHOT PHOTO ONLY: PrivateLessons.com members may upload ONLY their photographic head shot images
- NO OTHER IMAGES: ALL other images will be removed without notice
- ACCOUNT REMOVAL REQUEST: Members must request removal of account in writing. They must provide UserName and/or original email they used to create a PrivateLessons.com account
- ACCOUNT DISQUALIFICATION: We reserve the right to reject and/or discontinue any account, for any reason
- NEUTRAL FACILITATOR: As a neutral facilitator, PrivateLessons.com is not involved in actual transactions between members and prospective students
- RESUME SORTING/POSITION: PrivateLessons.com is a membership-based service that uses a database and does not guarantee specific positions. As accounts are added and removed, order or search results may vary.
- NO GUARANTEES: PrivateLessons.com does not guarantee that members will obtain students or performing opportunities from this service.
3. PrivateLessons.com uses two authorized payment processors:
- PrivateLessons.com merchant account through BankCardUSA for standard credit card processing
- PayPal, Inc. for PayPal users and/or credit card payments via PayPal
4. PrivateLessons.com makes no guarantees or warranties as to the accuracy or
completeness of or results to be obtained from accessing and using the service.
PrivateLessons.com shall not be liable to any user or anyone else for any
inaccuracy, error or omission, regardless of cause, in PrivateLessons.com or for
any damages resulting therefrom.
5. Members contributing materials on any of PrivateLessons.com Web pages, both public and private,
do so at their own discretion and are responsible for the
content of that material. PrivateLessons.com has no responsibility for the content
of any messages or information posted by users, or for the content of information
of third-parties on the Internet, even if accessed through PrivateLessons.com'
pages. PrivateLessons.com retains the right, in its sole discretion, to delete from
the Service any material which we deem to be inappropriate.
6. PrivateLessons.com makes no guarantee that the functions or the services provided
by or through PrivateLessons.com will be error-free or without defect. We
will not be responsible for any damage members may suffer, including but not limited to,
the loss of data or interruption of service.
7. The user agrees to indemnify PrivateLessons.com from any damages, losses,
costs or expenses which PrivateLessons.com, its affiliates, their respective
employees and authorized representatives may incur as a result of material
entered into these Web pages by the user.
